Terms of Service

1. Acceptance of terms

By downloading, installing, or using the FashUp application or website (“Service”), you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the Service.

2. Description of service

FashUp is a digital wardrobe management and AI-assisted outfit suggestion application. It is designed exclusively for fashion styling and virtual outfit visualisation. The Service may not be used for any other purpose.

3. Eligibility

You must be at least 16 years old to use FashUp. By using the Service you represent that you meet this requirement.

4. User accounts

• You may sign up with email / password, Google Sign-In, or Sign in with Apple (iOS).
• You are responsible for keeping your account credentials secure.
• You must notify us immediately at support@fashup.app if you suspect unauthorised access.
• You may not create accounts on behalf of others without their consent.

5. User content

You retain ownership of all photos and content you upload (“User Content”). By uploading User Content you grant FashUp a limited, non-exclusive, royalty-free licence to process and store it solely for the purpose of providing the Service to you.

You are solely responsible for ensuring you have the right to upload any content. You must not upload content that:

• Infringes third-party intellectual property rights
• Contains nudity, explicit sexual content, or material that violates applicable law
• Is intended to harass, abuse, or harm others

6. AI features & consent

Certain features use third-party AI services (OpenAI) to process your clothing photos. Before the first AI operation, you will be shown an in-app consent disclosure explaining what data is sent, to whom, and why. You must accept this disclosure before AI features are activated. You may withdraw consent at any time via Settings → Privacy Disclosure → Revoke Consent.

AI outputs (outfit suggestions, item analysis) are for informational purposes only and do not constitute professional advice of any kind.

7. Prohibited uses

You agree not to:

• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated scripts, bots, or scrapers against the Service
• Attempt to gain unauthorised access to other users' accounts or data
• Use the Service for any unlawful purpose or in violation of these Terms
• Upload or generate content that is obscene, harassing, or discriminatory

8. Intellectual property

All trademarks, logos, and proprietary content within the Service belong to FashUp or its licensors. Nothing in these Terms grants you any right to use them other than as necessary to use the Service.

9. Service availability & changes

FashUp reserves the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We will make reasonable efforts to notify users of significant changes.

10. Disclaimer of warranties

The Service is provided “as is” and “as available” without any warranty of any kind, express or implied, including but not limited to fitness for a particular purpose or non-infringement. Use of the Service is at your own risk.

11. Limitation of liability

To the maximum extent permitted by applicable law, FashUp shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

12. Account termination

You may delete your account at any time via Settings → Security → Delete My Account. Upon deletion your personal data will be permanently removed within 30 days. FashUp may suspend or terminate accounts that violate these Terms.

13. Governing law

These Terms are governed by applicable law. For users in Turkey, Turkish law and the jurisdiction of Turkish courts apply. Users in the EU/EEA may also have rights under applicable EU consumer protection and data protection law.
